Another method of obtaining DNA samples is in cases in which legislation authorizes or mandates the collection of DNA evidence from persons charged with or convicted of specified offenses.

Every Federal court of appeals that has considered the constitutionality of a statute compelling a person convicted of an offense to provide DNA for databasing has upheld the law in question. 18
